Local Ordinance in San Antonio

San Antonio adopted its credit access business ordinance on September 20, 2012 (Ordinance No. 2012-09-20-0739), and it applies to loans made after January 1, 2013. Payday and auto title lenders must hold a current city registration in addition to their state license. A payday loan cannot exceed 20 percent of the borrower's gross monthly income, and a title loan cannot exceed 3 percent of gross annual income or 70 percent of the vehicle's value. Loans are limited to four installments or three rollovers, and each installment or renewal must reduce the principal by at least 25 percent. Contracts must be in a language the borrower understands and read aloud to anyone who cannot read, and lenders must provide information on nonprofit financial education and cash assistance programs.
