Local Ordinance in Austin
Austin was one of the first Texas cities to regulate payday and auto title lenders. Ordinance No. 20110818-075, passed August 18, 2011 and effective January 1, 2012, added Chapter 4-12 to the City Code. Every credit access business must register with the city and keep loan records for three years. A single-payment payday loan may not exceed 20 percent of your gross monthly income; a title loan may not exceed the lesser of 3 percent of gross annual income or 70 percent of the vehicle's retail value. Installment loans are limited to four installments, each paying at least 25 percent of the principal, and cannot be refinanced. A lump-sum loan can be refinanced at most three times, each time cutting the principal by 25 percent. Lenders must also hand you a referral form listing nonprofit financial counseling; in May 2020 the chapter was extended to credit services organizations.
